Right to Rent guidelines clarified in relation to foreign students

Right to rent to be rolled out in Scotland, Wales and Northern Ireland

The Residential Landlords’ Association has obtained clarification from the Home Office in relation to Right to Rent checks required for foreign students starting courses in the UK. In cases where there is no time limit on how long the student can stay in the UK, as is the case for UK citizens and EU nationals, checks can be performed at any time before the residential tenancy agreement is granted. However, where a person has a time limited right to remain in the UK, as applies to overseas students from outside of the EU, checks should be performed not more than 28 days before the residential tenancy agreement comes into effect. In these cases landlords are free to arrange tenancies in principle in advance, but must undertake checks within the specified 28 day period as immigration status can change over time.
