Confusion reigns over Right to Rent requirements
Home Office guidance relating to Right to Rent checks does not appear to explicitly state when such checks must be made. Some industry insiders are currently interpreting the requirements as the check must be made in the 28 day period leading up to the tenancy start date. Others however are stating that the 28 day period refers to the lead up to the tenancy agreement being entered into. Although for many tenancies this may not appear to be a crucial difference it certainly comes into consideration when dealing with student tenancies or similar, where agreements may be made several months prior to the actual tenancy start.
